These General Conditions have been prepared according to the Spanish legal system: Law 34/2002 on Services of the Information Society and Electronic Commerce, Law 7/1998 on General Contracting Conditions, the Real Decree 1906/1999 by which the telephone or electronic contracting is regulated with general conditions in development of article 5.3 of Law 7/1998, General Law 26/1984 for the Defense of Consumers and Users, Law 7/1996 of Ordination of Retail Trade, Royal Decree-Law 14/1999 regulating the Electronic Signature and how many legal provisions are applicable.
The use and/or purchase of any of the products on the Website implies acceptance as User, without reservations of any kind, to each and every one of these General Conditions, as well as to the Particular Conditions that, where applicable, govern the purchase.
LAPASTILLA informs that the procedures needed to perform a purchase of any product are those stated in the General Conditions, as well as the specifics that are stated on the screen during navigation, so that the User declares his or her knowledge and acceptance of these procedures as necessary to access the products and services offered on the website.
1.2 – Information Prior to Engagement
LAPASTILLA reserves the right to decide at any time the products that are offered to the Users through the website. Also, to eliminate at any time and without notice any of the products offered.
1.3 – Purchase Procedure
To purchase products on the LAPASTILLA website. Users will be asked to fill series of data, some of them are mandatory if there is a purchase process with/without registration and must follow the instructions specified at any time on the website.
Once the purchase has been made and within the shortest possible time, LAPASTILLA will send an e-mail to the User/Purchaser a proof of purchase. Likewise, the User/Buyer may request the corresponding invoice within a period of one month counted from the delivery. The order confirmation and proof of purchase will not be valid as invoice.

1.4 – Shipping
The shipping cost is included as long as the total final order exceeds 120 euros (with taxes included).
The transportation cost of high-volume merchandise or that need assembly, or the need of climbing stairs is not included, the transporter will leave the merchandise at street level. The assembly is not included unless otherwise indicated in the specific conditions of each product. These types of services can be done, but they will have an additional cost. You must also make sure that the product can enter through the elevator or stairwell. If the additional transport service has not been hired, the User/Buyer will be responsible to the package to the desired location by their own means.
For areas outside the peninsula of Spain, the customs expenses of destination, as well as the taxes of the area, will not be included (see Customs Information). In case the client refuses to pay the taxes corresponding to the import, the merchandise will be retained in its respective customs. No refund will be accepted.
1.5 – Merchandise Receiving Conditions
The customer is responsible for receiving the goods.
Inspect the merchandise at the moment of their reception and write down any observations in case of bad condition, in the same delivery note of the carrier: DAMAGED PACKAGING.
In case of not being able to carry out the inspection at the time of receipt, you must write down on the delivery note of the carrier: “Pending review”, “Agreed, except examination”
No claim for merchandise will be accepted, without due observation on the carrier’s delivery note.
Notify LAPASTILLA after-sales service department within 48 hours.
1.6 – Delivery Deadlines
- Products in stock: Delivery time from 24 hours to 72 hours (in Spain Peninsula, for other destinations consult us).
- Manufactured products or not in stock: delivery time varies between 3 days to 45 days (Spain peninsular, for other destinations consult us).

1.7 – Customs Related Information
Any additional expenses due to the payment of customs duties and/or tariffs will be carried by the recipient. LAPASTILLA absolutely does not know those expenses and it is not possible to calculate its amount. This is because the customs policies vary significantly from one country to another, we advise you to contact the corresponding customs office, to obtain information about the tariffs and the import restrictions that apply to certain products.
Some countries customs offices require the registered importer to provide some type of identification before proceeding with the delivery. As a registered importer, you may be asked, either by you or by the person to whom you are directing the shipment, to provide a personal identification number, such as the N.I.F. or VAT.
LAPASTILLA is not responsible for customs retentions. In case the client refuses to pay the taxes corresponding to the import, the merchandise will be retained in its respective customs. Returns will not be accepted.
1.8 – Payment Methods and Prices
The prices at the time of the purchase are those that appear on the screen. The prices in Spain peninsula and the Balearic Islands are the only ones including the Value Added Tax (VAT), in the rest of territories or countries the prices will be without taxes (net prices with taxes excluded).
In case there was a typographical error, we will contact the customer as soon as possible to offer a solution.
Purchases made by residents of non-EU countries will be exempt from VAT payment and subject to the payment of the import tax that may apply (see customs information).
Due to the special tax regime, the geographic areas corresponding to the Canary Islands, Ceuta and Melilla are considered to be extra-community territories.
The shipping costs that appear on the screen will be paid by the User and correspond to the rates set by the transport agency contracted at any time and will be based on the destination and weight of the shipment.
Prices will always be shown in EUROS. The final invoice will always be sent in EUROS.
All forms of payments offered on the website are in advance.

All possible bank fees will be paid by the client.
NOTE: It is very important for transfers or incomes in the SENDING or ORDERING field to indicate the name of the final customer and in the SUBJECT must indicate the order number, budget number or invoice number.
We inform you that we will send you an invoice for each shipment if requested. Let us know if you need a single invoice for several partial shipments. If you wish to modify ANY DATA on the invoice once sent, you must notify us WITHIN A MAXIMUM PERIOD OF 10 DAYS through our contact form, by e-mail or by phone.
1.9 – Return of Purchased and Shipped Products
The Customer will have a maximum period of fourteen (14) calendar days from the delivery of the Product to cancel, totally or partially, the purchase of the Product, in accordance with the applicable legislation. The cost of return will be carried by the customer, unless the product was already damaged, as a result of the shipment or was wrongly placed by LAPASTILLA. The price of transport will be determined in each case. To proceed with the return, send an email to firstname.lastname@example.org with the name of the product, the invoice number/order form and the reason for the return. Once the email is received, LAPASTILLA will reply within a period of less than 48h. (working days), indicating if it is necessary to follow the procedure to return the product.
Once the term of fourteen (14) calendar days has expired, LAPASTILLA will not accept returning any product purchased.
The Client will not have the right to desist in the cases established in the regulations that are applicable, and especially, with an enunciation and non-limiting character, in the following cases:
Products made according to the Client’s specifications or clearly customized upon his or her request.
For reasons of hygiene and health, LAPASTILLA restricts the return of hygiene products, products susceptible to be in contact with the skin, food products only in the case that they have been unsealed after delivery, therefore, it will not be accepted to return them. Likewise, the return of any software for sale in our catalog will not be accepted if the installation or activation of the same or the packaging, if the seal has been opened or manipulated. This is due to the characteristics of this type of product that requires a license, registration or activation.
In case of product’s return “under order”, accessories and spare parts, LAPASTILLA reserves the right to charge between 20% to 50% of the amount of the product as expenses.
Once the product has been received, LAPASTILLA will check the correct receipt of the returned Product in our warehouse, reserving the right not to make the refund in case of detecting that the purchased Product is not received in perfect conditions. In the case that it is not received in its original packaging, this will mean a decrease in the value of the product.
LAPASTILLA will manage the return of the price and shipping costs through the same payment method used by the Client for the purchase of the Products. No additional cost will be returned for standard shipping costs, such as express, priority or courier service. The installments will be made in EUROS.

The communications of LAPASTILLA to the User will be made according to the data provided by the User when registering on the website. The User expressly accepts for all communications related to the use of the website, and/or to the purchasing of products, and the use of electronic mail as a valid procedure for the submission of such communications.
1.12 – Legislation and Applicable Jurisdiction
These General Conditions, as well as the Particular Conditions, if applicable, are established, and will be interpreted and governed in accordance with the laws in force in Spain. In case of controversy, it will expressly submit to the Jurisdiction of the Courts and Tribunals competent in said matter.
1.13 – Warranty
The guarantee of the products sold by LAPASTILLA is provided and established by virtue of regulations contained in the current legislation, in particular, in the aforementioned R.D. 1/2007, article 114 et seq., The guarantee is addressed only to the owner (contractual party) who appears on the invoice and only the owner may demand it.
The warranty will lose its value:
In case of improper use or not following the instruction manual of the product.
If they modify, alter or replace some of the data or proof of purchase.
If the guaranteed device is manipulated or repaired without the knowledge of the Technical Service.
If it has no invoice.
In case of power surges or connection to an inadequate voltage.
